As is already understood, this transaction carries risk. You may incur losses or lose your funds. You are advised not to apply for financing if you do not have the ability to repay, and to consider carefully before transacting.
Information Technology-Based Lending Services ("Fintech Lending") constitute a civil agreement between the Lender and the Borrower, therefore all risks arising from such agreement are fully borne by each party.
Credit risk or default risk is fully borne by the Lender. No institution or government authority is responsible for such default risk or provides compensation for losses or any other consequences arising in connection with it in any form.
With the approval of each User (Lender and/or Borrower), the Operator accesses, obtains, stores, manages, and/or uses the User's personal data ("Data Utilization") on or within objects, electronic devices (including smartphones or mobile phones), hardware and software, electronic documents, applications, or electronic systems owned or controlled by the User, by informing the relevant User of the purpose, limitations, and mechanism of such Data Utilization before obtaining the said approval.
Lenders who do not yet have sufficient knowledge and experience in Fintech Lending are advised not to use this service.
Borrowers must consider the profit-sharing portion and other costs in accordance with their repayment ability before using Fintech Lending facilities.
Any fraud is digitally recorded in cyberspace and may become publicly known through social media and may serve as valid legal evidence under applicable laws and regulations regarding electronic information and transactions in dispute resolution and law enforcement processes.
Users must read and understand this information before making a decision to become a Lender or Borrower. A User's decision to use this Fintech Lending facility constitutes proof that the User has understood this information.
The government, in this case the Financial Services Authority, is not responsible for any violation or non-compliance by Users, whether Lenders or Borrowers (whether intentional or due to negligence), against applicable laws and regulations or any agreement or engagement between the Operator and the Lender and/or Borrower.
Every transaction and lending activity or implementation of any lending agreement between or involving the Operator, Lender, and/or Borrower must be carried out through an escrow account and virtual account as required under Financial Services Authority Regulation Number 77/POJK.01/2016 concerning Information Technology-Based Lending Services, and any violation or non-compliance with such provisions shall constitute evidence of legal violation by the Operator, so that the Operator must bear compensation for losses suffered by each User as a direct result of such legal violation, without prejudice to the rights of Users who suffer losses under the Indonesian Civil Code.
Unless otherwise stipulated, all definitions above refer to the definitions set out in the General Terms and Conditions. Every User is required to read and understand Amartha's Terms and Conditions and Privacy Policy.
